Hurdy Posted May 21, 2004 Report Share Posted May 21, 2004 ...having photos published?My 17 year old daughter (art student) has found a niche photographing local bands. Obviously she is only starting out but has been asked by four bands so far to take their photos. The photos are used for posters and flyers and the one band are going to put them on their website and their next DVD.Now a small magazine has asked whether they can publish some of her work. Up until now she hasn't charged (obviously) she's just thrilled to get into gigs for free and be called 'the photographer' :lol:I'm not concerned whether she makes any money at this stage but if she has her work published should she have control over the rights etc? catgate Posted May 21, 2004 Report Share Posted May 21, 2004 The situation used to be (in years gone by when I used to do a bit of portrait photography) that the copyright of the photograph was vested in the "originator" of the photograph, not the photographer, unless the photographer had taken the initiative and taken the photograph (in a "public place") of his own volition. This latter aspect, now a days, seems to be full of catches mostly called Zeta Jones or Michael Douglas or perhaps even both! Quote Link to comment Share on other sites More sharing options...

catgate Posted May 21, 2004 Report Share Posted May 21, 2004 It would seem so to me. However the band should be recompensing her adequately if they are going to use the photographs professionally. She could insist that she would only do the job gratis if they would allow her to "advertise" along the bottom of the picture (you know ..."Photos by Hurdy's daughter" sort of thing).
