First to fall under New York's new identity thief statute

THE BUFFALO SPAMMER is no longer free to roam after being banged up for seven years.

Howard Carmack was convicted on 14 counts of forgery, fraud, identity theft and other crimes earlier this year and was sent down yesterday.

Friends for the prosecution said that Carmack sent out hundreds of millions of email ads as part of a fraud scheme. He was charged with nicking the identity of two people to open internet access accounts with EarthLink. He also forged the headers of emails sent from the EarthLink accounts, and was caught by Inspector Knacker with software designed to create forged emails.

Carmack used 343 stolen identities to sign up for email accounts through which he sent about 825 million spam emails flogging spamming software, herbal sexual stimulants and bulk email lists. You are bound to have seen his work captured for ever in your spam filter or in-box.

He had to hand over a lot of his hard earned cash last year when EarthLink won a $US16.4 million civil judgment against him. However the criminal prosecution was the first to fall under New York's recently enacted identity theft statute.

Spinsters for Earthlink were over the moon at the result. In a statement they warned other spammers that they could face more of the same.
