Smiffy99 Posted April 13, 2004 Report Share Posted April 13, 2004 Hi all,A quick browse through this forum shows a considerable number of names that I recognise from "that other place" and so I thought it only polite that I should ask your views as to my joining your forum and the reasons for my wanting to do so.Basically, as many of you will know from "that other place" I have more than a little interest in the law and legalities. Most of my posts "over there" relate in some way to the law with a smattering of PC advice. The reason for my interest is that at 38 years of age I am entering the legal profession, and having completed a law degree I am studying the legal practice course at the Inns of Court School of Law in Gray's Inn, London at the not insignificant cost of £9,500 plus £4,000 for travel. I am no "expert" in the law, but I do feel that I have an advantage over the layman!To reason from my dissatisfaction with "the other place" is despite the fact that it purports to fight for consumers rights and advise on consumer issues all too often I am faced with an "opinion" of the moderator which has absolutely no basis, authority, or place in the law. Whilst I respect everybody's opinion, be it right or wrong, what I find difficult to accept is that the moderator's position, (I hesitate to use the word "editor" lest we inadvertently become too personal) is that of spokesperson of a respected publication. If he is to categorically state the law then he does so on behalf of the magazine. My problem is that when he is wrong he refuses to stand corrected despite an abundance of legal authority being pointed out to him. He will close or lock any thread that he disagrees with and remove posts so as to leave “his” version of the law intact. This is wrong, both for the users of the forum and also for the magazine appearing as it does that this is also their view of the law. He has a layman's understanding of the sale of goods act and refuses to accept the proposition that "delivery" and "ownership" in law has an entirely different meaning from their everyday connotations. When confronted he has stated that what happens in the Court of Appeal has no application to the “real world” and did not like the fact that I pointed out what happens in that court is a direct result of what happens in the “real world”.My point is this – I would like to be able to use a forum where I can exercise my, albeit yet “unqualified” legal skills to good effect and benefit others. I will state the law as I see it and have network access from my desktop to legal materials that most firms of high street solicitors can only dream of (I am employed by legal publishers in Chancery Lane - see http://www.butterworths.com/butterworths.asp to see what I mean). I would offer my opinion as to any aspect of the law and especially consumer and Sale of Goods Act issues. What I get in return is the opportunity to use “real” cases and situations to further my knowledge and experience. If you feel that I may be in the right place and that I may make a valuable contribution please let me know. There aren't many people who like to have it pointed out to them that they are wrong, and when one has the freedom to edit so they aren't proved such then there will be the tendancy to do so.Providing people know that you can only speak as someone who has understanding but not authority, and you never claim things which you know not to be true then again can see nowt wrong in what you want to do.No need for things to get bitchy with this place or the other place, the Internet is about sharing and this is one way that it can happen.
